Divorce Appraisals
Finalizing a divorce involves many decisions, including "Who gets the house"? There are generally two options:
- the house can be sold and the proceeds divided
- or one party can "buy out" the other
Divorce appraisals require a well supported, professional appraisal that is defensible in court.
It is important to understand the appraiser by law is required to not be an advocate for a cause or interest of any party or issue. A lawyer is your advocate - the appraiser can not be an advocate - and in a perfect world the appraised value would not change depending on if the husband or wife ordered or paid for the appraisal.
Unfortunately the appraisal used in divorce proceedings can not also be used to get a mortgage loan. Federally regulated lenders have not been allowed for many years to accept appraisals provided by the borrower, and even more recently there are strict restrictions on who can arrange for the appraisal for mortgage lending - often taking that ability from anyone who would benefit financially from the loan (which often includes loan agents, loan brokers, etc.).
